Terms of Service

1. Who we are, and your agreement with us

Famroot is provided by Famroot Private Limited, a company incorporated in India ("Famroot", "we", "us"). These Terms govern your use of the Famroot websites, mobile applications, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years of age and legally capable of entering into a contract to hold a Famroot account. The "Famroot" name and logo are trademarks of Famroot Private Limited; these Terms give you no right to use them.

2. Early access

The Service is currently offered as an early-access (alpha) release. We are actively building it: features may change, be interrupted, have errors, or be withdrawn at any time, and we may impose or change limits on usage or storage. Although we take reasonable care with your data, early-access software carries an inherent risk of loss, so please keep your own copies of content that is important to you (for example, using the tree export feature). We make no promise that any experiment or feature will remain available.

3. Free service and future subscriptions

The Service is currently free to use. We may introduce paid subscriptions in the future, and some existing or new features may become part of a paid plan. We will give you reasonable advance notice before anything you use becomes chargeable, and you will never be charged without your agreement. We are under no obligation to keep any particular feature free.

4. Your account

Your account is created with your mobile number and verified by OTP. Provide accurate information, keep your password, OTPs, and Vault password confidential, and do not share your account. You are responsible for all activity under your account. Tell us promptly at support@famroot.com if you believe your account has been accessed without your permission.

5. Your content

You own the content you add to Famroot: your family-tree information, photos, media, moments, notes, and Vault items ("Your Content"). We claim no ownership over it.

So that we can run the Service, you grant Famroot a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers) licence to host, store, reproduce, adapt (for example, resizing images, generating previews, and building search indexes), publish, distribute, and display Your Content, solely to operate, provide, improve, and promote the Service, and always consistent with your sharing settings. This licence ends when you delete Your Content or your account, except that (a) content you shared with other users may remain in their trees and copies, (b) it continues for aggregated or de-identified data that no longer identifies you, and (c) residual copies may persist in backups for a limited period. Suggestions or feedback you send us may be used without restriction or compensation.

6. Information about other people

Famroot is built for recording family, which means adding information about people other than yourself. When you do, you are responsible for having the right to do so:

• Before adding personal information about a living person (their name, dates, photos, contact details, addresses, or anything else), you confirm that you have their consent.
• For a living person under 18, you confirm that you are their parent or guardian, or have the consent of their parent or guardian.
• Before inviting someone to Famroot, you confirm that they have agreed to be contacted, since we will send them an SMS or message on your behalf.
• Information about deceased persons may be added as part of your family history; treat it with respect and accuracy.

If someone objects to information about them on the Service, we may restrict or remove it, and they may write to grievances@famroot.com.

7. Acceptable use

Do not misuse the Service. In particular, do not:

• break any applicable law, or upload content that is unlawful, obscene, defamatory, infringing, impersonates another person, is harmful to children, or is knowingly false or misleading;
• add another person's information for any purpose other than genuine family and personal record-keeping, or harvest, scrape, or bulk-extract data from the Service;
• attempt to access accounts or data that are not yours, probe or disrupt the Service, bypass its security or rate limits, or access it by automated means without our written permission;
• send spam or unwelcome invitations, or use Famroot's messaging features to harass anyone.

8. Accuracy of content and unexpected discoveries

Most content on Famroot is contributed by users, and we do not verify it. Family history is personal: you may come across information about yourself or your family that is unexpected, inaccurate, incomplete, or upsetting, and records created by relatives may differ from your own. You use the Service with that understanding and assume the risks of such discoveries, and you agree not to hold Famroot responsible for their social, emotional, or legal consequences. Nothing on the Service is professional, legal, or medical advice.

9. Suspension and termination

We may suspend, restrict, or terminate your account, and remove content, if you misuse or abuse the Service, breach these Terms, create risk or possible legal exposure for us or other users, or where required by law. We may also modify or discontinue the Service itself, with reasonable notice where practicable. You may stop using Famroot at any time and request deletion of your account. Sections 5–14 survive termination to the extent applicable.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without any guarantee or warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and make no promises that the Service will be uninterrupted, timely, secure, or error-free, that content will be accurate or preserved, or that defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, Famroot Private Limited, its directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or opportunities, arising out of or relating to the Service or these Terms, whatever the legal theory and even if we were advised such damage was possible. Our total aggregate liability for all claims is limited to the greater of (a) the amount you paid us, if any, in the 12 months before the event giving rise to the claim, or (b) ₹1,000.

Nothing in these Terms limits any liability that cannot be excluded under applicable law. If you are in a jurisdiction that does not allow some of these limitations, they apply to you only to the extent permitted there.

12. Your responsibility to us

You agree to indemnify and hold Famroot harmless from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or of another person's rights, including adding someone's personal information without the consent described in Section 6.

13. Changes to these Terms

We may update these Terms as the Service evolves or for legal, regulatory, or security reasons. For material changes we will give you reasonable advance notice in the product or by message. Continued use of the Service after a change takes effect means you accept the revised Terms; if you do not agree, stop using the Service and request deletion of your account.

14. Governing law and disputes

These Terms are governed by the laws of India, and the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms.

15. Grievances and contact

For complaints or grievances, including about content or your data, contact our Grievance Officer at grievances@famroot.com. We acknowledge complaints within 24 hours and aim to resolve them within 15 days, in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
